Online Store Terms and Conditions – CardHorizon.com

Effective as of 5 November 2025

In the event of any discrepancies, interpretative doubts, or disputes regarding the content of these Terms and Conditions, the Polish language version shall prevail and shall be the only legally binding version. The English version is provided solely for convenience and is an informational translation only.

We are here to provide you with the best possible experience. We care about your rights as a consumer; therefore, our Terms and Conditions comply with the Consumer Rights Act (Journal of Laws 2020, item 287, as amended).

All provisions of our Terms and Conditions are designed to be clear, fair, and beneficial for you. If any wording raises doubts, we will always interpret it in your favor. Remember that as a consumer you are fully protected, and we will always act in accordance with the applicable legal regulations.

Below are the Terms and Conditions of the CardHorizon.pl Online Store, drawn up in accordance with the Omnibus Directive and the applicable laws of Poland and the European Union.

§1. General Provisions

  1. The provider of the online platform www.cardhorizon.com (hereinafter: the “Store”) and the contracting party for Users is Card Horizon Sp. z o.o. (hereinafter: “CardHorizon”). Company details are as follows:

  2. The following provisions define the rules for using the CardHorizon Store and govern all transactions and legal actions between you and CardHorizon. In certain cases, additional terms may apply to specific types of orders — such terms will be presented before using the relevant service.

  3. CardHorizon enables Users to submit purchase offers for products available in the Store, including pre-order products. The Store may also allow Users to order personalised products (e.g., cards with a dedication).

  4. All products available in the Store comply with the agreement within the meaning of Article 43b(1) and (2) of the Polish Consumer Rights Act.

  5. These Terms and Conditions set out the rules for the functioning and use of the Store. They apply to both consumers and business customers, with the reservation that provisions more favourable to consumers arising from the Consumer Rights Act shall prevail.

  6. Detailed rules for the processing of personal data and the protection of Users’ privacy are set out in the Privacy Policy, available in the “Privacy Policy” section of the Store’s website.

  7. Detailed rules concerning returns and complaints are specified in the Returns and Complaints Policy, available in the “Returns and Complaints Policy” section of the Store’s website.

  8. In certain cases, such as during promotional campaigns, CardHorizon may introduce conditions of offers or sales that differ from those set out in these Terms and Conditions. Users will be informed of such conditions before using the respective offer.

  9. Products presented in the Store do not constitute an offer within the meaning of the Polish Civil Code; they are solely an invitation for Users to submit purchase offers.

  10. The product price displayed in the Store is provided in Polish złoty (PLN) and includes taxes. Information on the total price including taxes, delivery costs, and any other fees is provided before placing an order and is binding on CardHorizon.

  11. To fully use the CardHorizon Store, we recommend the following technical requirements:
    • A device with Internet access
    • A computer, laptop, tablet, or smartphone
    • Access to electronic mail
    • An active e-mail account for registration and communication
    • Internet browser — latest versions of:

    • Mozilla Firefox

    • Safari

    • Microsoft Edge

    • Opera
      • Browser settings enabling:

    • JavaScript

    • Cookies storage

    • HTML5
      • A fast and stable Internet connection for optimal Store performance.

§2. Definitions 

Account – an Electronic Service, a set of resources in CardHorizon’s ICT system assigned to the User and identified by a unique username (login) and password provided by the User, in which data provided by the User and information about Orders placed by the User in the Store are stored.

Article – informational content published on the Store’s website.

Business Day – a day from Monday to Friday, excluding statutory public holidays.

Buyer – a User who (1) has placed an Order in the Store to conclude a Sales Agreement, or (2) has concluded a Sales Agreement.

Civil Code – the Polish Civil Code of 23 April 1964 (Journal of Laws 1964 No. 16, item 93; consolidated text: Journal of Laws 2022, item 1360, as amended).

Consumer – pursuant to Article 22(1) of the Civil Code, a consumer is a natural person performing a legal act with an entrepreneur that is not directly related to their business or professional activity.

Consumer Rights Act – the Polish Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827; consolidated text: Journal of Laws 2020, item 287, as amended).

Contact Form – an Electronic Service enabling the User to send a message to CardHorizon.

Customized Goods – a collectible card or product personalised according to the Buyer’s specifications or supplied as a special order (e.g., cards with dedications, engraved cards, custom-designed cards, limited editions, preordered cards).

Database – a collection of data, information, and other content voluntarily provided by Users, collected and processed with their consent for the purposes of Store operations.

E-mail Address – an individual electronic mail address through which the User can send and receive messages and other data.

Electronic Service – a service provided electronically by CardHorizon to the User via the Store.

Force Majeure – extraordinary external circumstances beyond the control of CardHorizon, arising after acceptance of the Terms and Conditions and impossible to foresee, such as natural disasters, fires, explosions, acts of war, or acts of state authorities.

Goods – any item offered for sale by the Store.

Newsletter – an Electronic Service enabling Users to receive periodic email communications from CardHorizon containing information about Goods, new releases, and promotions. These communications may include commercial content.

Order – an offer to conclude a Sales Agreement submitted by the Buyer using the Order Form.

Order Form – an Electronic Service enabling the Buyer to submit an offer to conclude a Sales Agreement, including adding Goods to the cart and selecting delivery and payment options.

Presale / Preorder – the ability to order a product not yet available for sale but expected to become available, typically collectible cards not yet officially released.

Privacy Policy – (if needed, can be added, but not included in §2 source; leaving out unless you request its inclusion)

Registration Data – personal data voluntarily provided by the User during registration or newsletter subscription, collected and processed to provide Store services and execute transactions.

Registration Form – an Electronic Service enabling the creation of an Account or subscription to the Newsletter.

Sales Agreement – a contract for the sale of Goods concluded between the Buyer and CardHorizon via the Store.

Store – the online service operated by CardHorizon at cardhorizon.com, enabling Users to purchase Goods.

Terms and Conditions – these regulations together with all annexes constituting an integral part thereof.

User – a natural person (with full or limited legal capacity), a legal person, or an organisational unit without legal personality but with legal capacity granted by law, using the Electronic Services of the Store.

§3. Access to CardHorizon Services 

  1. The following services are available in our Store:
    a) Registration Form – enables the creation of an Account or subscription to the Newsletter.
    b) Contact Form – allows Users to send messages to our team.
    c) Account – allows Users to manage orders, purchase history, and wishlists.
    d) Order Form – used to place orders for collectible cards.
    e) Newsletter – provides information about new releases, promotions, and events related to collectible cards.

  2. Use of the Account is possible after registration via the Registration Form, resulting in Account activation. The Account service is free of charge and available for an indefinite period. You may request deletion of your Account at any time and without stating a reason by sending a request, in particular via e-mail to: [email protected], or in writing to:

  3. Each User is entitled to use only one Account in the Store.

  4. Using other Users’ Accounts or sharing your Account with other Users is prohibited.

  5. Users are prohibited from using additional Accounts in any manner that violates these Terms and Conditions.

  6. Order Form – use of the Order Form begins when the Buyer adds the first Goods to the electronic shopping cart in the Store.

  7. The Electronic Service “Order Form” is provided free of charge, is a one-time service, and ends upon placement of an Order or when the User discontinues the ordering process.

  8. The Electronic Service “Registration Form” and “Contact Form” are provided free of charge, are one-time services, and end upon submission of data or earlier termination of data entry by the User.

  9. Subscription to the Newsletter is possible by selecting the appropriate checkbox in the Registration Form during Account creation or in the Order Form during order placement. Newsletter subscription is also possible by completing the dedicated Registration Form for Newsletter sign-ups.

  10. The Newsletter Electronic Service is free of charge and available for an indefinite period. You may request termination of Newsletter delivery at any time and without stating a reason by sending a request, in particular via e-mail to: [email protected], or in writing to the address indicated in point 2 above.

  11. In the event that CardHorizon receives an official notice or credible information regarding the unlawful nature of data stored by the User or related activities, CardHorizon reserves the right to immediately suspend the Account, preventing access to the Account or the data. The User will be informed of the suspension and the reasons for it.

  12. A User whose Account has been suspended may not re-register in the Store.

  13. The User undertakes to protect the data provided during registration (including login and password) against unauthorized access by third parties. Any disclosure of login credentials to third parties is at the User’s own risk.

  14. The User has the right to:
    modify their Registration Data in accordance with the Terms and Conditions;
    resign from using the Store;
    request the deletion of their Registration Data upon discontinuation of Store use.

  15. Materials posted in the Store, including documents, trademarks, texts, photographs, visualisations, and graphics, may be protected under the Polish Act on Copyright and Related Rights of 4 February 1994 (Journal of Laws 1994 No. 24, item 83; consolidated text: Journal of Laws 2022, item 2509, as amended) or the Industrial Property Law of 30 June 2000 (Journal of Laws 2001 No. 49, item 508; consolidated text: Journal of Laws 2021, item 324, as amended).

  16. The User is entitled to use the Store’s resources solely for their own personal use, unrelated directly to business or professional activity. This means, in particular, that materials contained in the Store—whether or not protected by copyright—may not be used for any business activity conducted by the User.

  17. Use of any copyrighted materials posted in the Store (including applied solutions and technical solutions) for business or professional purposes—including copying, transmitting, publicly sharing, or any other use—is permitted only with the Store’s consent.

  18. Use of copyrighted materials posted in the Store (including applied solutions and technical solutions) for business or professional purposes—including copying, transmitting, publicly sharing, or any other use—is permitted solely with the Operator’s written consent in the form of a written contract under pain of nullity.

  19. Actions likely to hinder or destabilize the functioning of the Store are prohibited. If such actions are detected, the User’s Account will be immediately blocked. The Store will also take all legal measures to remedy the damage. Such actions may also constitute a criminal offence under the Polish Penal Code of 6 June 1997 (Journal of Laws 1997 No. 88, item 553).

  20. The User undertakes to use the Store in accordance with applicable laws, social norms, customs, these Terms and Conditions, and with respect for personal rights and intellectual property rights of the Store and third parties, in particular to:
    act in a manner that does not violate the rights of other Users;
    regularly review updates to the Terms and Conditions and become familiar with them;
    provide data consistent with the facts;
    refrain from transferring the right to use the Account to third parties;
    refrain from impersonating other persons;
    refrain from violating the confidentiality of correspondence;
    refrain from attempting to obtain passwords of other Users;
    refrain from creating an Account with a name referring to commonly offensive or inappropriate expressions, protected trademarks or elements to which the User holds no rights, or names likely to mislead other Users, particularly those similar to names used by the Operator for Store service or communication;
    use Store tools in accordance with their intended purpose;
    refrain from providing unlawful content.

§4. How to Place an Order 

  1. A Sales Agreement between you and CardHorizon is concluded once you place an order using the Order Form and after we confirm acceptance of your order.

  2. Registration is not required. You do not need to create an Account to place an order. You may purchase collectible cards without registration by providing your details during the ordering process.

  3. An Order is placed after the Buyer completes both of the following steps:
    (1) filling out the Order Form, and
    (2) clicking the “Order and Pay” button on the Store’s website.
    Until the moment you click the “Order and Pay” button, you may freely modify the data entered. After placing the Order, you will receive a confirmation of receipt sent to the e-mail address provided.

  4. An Order is submitted after completing the following two steps:
    a) filling in the Order Form,
    b) clicking the “Order and Pay” button.
    Until this moment, you may freely modify the data you have entered.

  5. When placing an order, you must provide:
    a) your full name (or company name if you are an entrepreneur),
    b) your address (street, building/flat number, postal code, city, country),
    c) your e-mail address,
    d) your contact telephone number.

  6. After placing your order, you will receive an e-mail confirming that we have received it. This confirmation does not yet constitute acceptance of the order for processing.

  7. You will receive a separate e-mail once your order is accepted for processing. The Sales Agreement is concluded at the moment you receive this e-mail.

§5. Payment Methods and Order Processing Times 

  1. CardHorizon provides the Buyer with the following methods of payment for the Sales Agreement:
    • bank transfer to the Operator’s bank account;
    • electronic payments – the currently available payment methods are specified on the Store’s website in the information section on payment methods.

  2. If the Buyer selects payment by bank transfer or electronic payment, the payment must be made within 48 (forty-eight) hours from the date and time of placing the Order. Failure to make the payment within this timeframe may result in the Order being rejected. The date of payment is deemed to be the date on which the funds are credited to the Store’s bank account. If payment is not made within the specified period, the Buyer will be informed of the possibility to extend the payment deadline or cancel the Order.

  3. A fiscal receipt is issued for each Order, or—upon the Buyer’s request—a VAT invoice.

  4. Cancellation by the Buyer of a paid Order for Customized Goods will not be possible if, prior to receiving the Buyer’s statement of cancellation, the Store promptly confirms receipt of the Order and declares acceptance of the Order for processing. This follows from Article 66[1] §1 of the Polish Civil Code and Article 38(1)(3) of the Consumer Rights Act.

§6. Delivery and Order Fulfilment 

  1. The Buyer may choose the method and place of delivery of the Goods from among the delivery options made available by the Store.

  2. Delivery of Goods is available within the territory of the European Union.

  3. Delivery of Goods to the Buyer is subject to a fee unless the Sales Agreement provides otherwise. The delivery costs of the Goods (including transport, shipping, and postal service fees) are indicated to the Buyer on the Store’s website in the information section regarding delivery costs, as well as during the Order placement process—including at the moment when the Buyer expresses the intention to be bound by the Sales Agreement.

  4. Personal collection of Goods by the Buyer is free of charge. Personal collection is available at the registered office of CardHorizon.

  5. Goods may be dispatched only after payment for the Goods has been received.

  6. Depending on the current offer and the type of Goods, the Goods are dispatched or made available for personal collection within 2 (two) Business Days.

  7. If the Buyer places one Order containing Goods with different delivery times, the entire Order will be delivered or made available for personal collection within the delivery time applicable to the Good with the longest delivery time. The Buyer may request earlier delivery of a specific Good included in the Order, provided that it is possible for that type of Good. Such a request should be sent to: [email protected]. CardHorizon will inform the Buyer of the possibility of earlier delivery and any additional costs.

  8. If the Buyer does not pick up the Goods using the delivery option selected during the Order placement, the delivery time does not include the period during which the shipment remains ready for collection at the location corresponding to the chosen delivery option.

  9. Delivery of Goods is carried out with the right to draw up a damage report for potential complaints if the Buyer refuses to accept the shipment due to damaged packaging.

  10. The shipment is delivered to the address provided by the Buyer, and acceptance of the shipment by a person indicated by the Buyer as authorised to receive it on their behalf is deemed effective.

  11. In exceptional cases, CardHorizon reserves the right to consider a complaint even if the conditions of delivery specified by the carrier (courier) used by the Store have not been fully met.

  12. CardHorizon enables full processing and bookkeeping of payments in euro (EUR). However, the primary, base, and reporting currency remains the Polish złoty (PLN), in accordance with applicable Polish law.

§7. Articles 

  1. Articles constitute an integral part of the Store.

  2. Browsing Articles is open and does not require registration in the Store.

  3. Articles have been prepared with the highest level of care and with the use of the authors’ extensive qualifications, knowledge, and experience. The suggested guidance and advice represent the authors’ opinions, and their application may require additional, in-depth consultation.

  4. The Operator does not provide advisory services nor issue recommendations to enter into transactions within the meaning of Regulation (EU) No 596/2014 of the European Parliament and of the Council of 16 April 2014 on market abuse (Market Abuse Regulation), repealing Directive 2003/6/EC of the European Parliament and of the Council and Commission Directives 2003/124/EC, 2003/125/EC, and 2004/72/EC (OJ EU L 173, p. 1).

§8. Rights and Obligations of CardHorizon 

  1. CardHorizon reserves the right to withdraw any collectible cards from the Store.

  2. In the event of a violation of the Terms and Conditions, we reserve the right to suspend, block, or permanently delete a User’s Account.

  3. CardHorizon shall not be liable for:
    • the manner in which Users use the Store;
    • interruptions in Store operation caused by force majeure;
    • damages resulting from improper use of the Store;
    • events arising from the disclosure of Account data to third parties or from reasons attributable to the User;
    • unlawful actions of third parties, such as hacking or computer viruses.

  4. We will make every effort to ensure that the information and articles concerning collectible cards are reliable and accurate.

  5. We undertake to comply with the provisions of these Terms and Conditions with respect to all Users.

  6. We reserve the right to:
    • temporarily or permanently suspend Store operations in the event of failure, force majeure, or technical maintenance;
    • temporarily disable Store services in emergency situations, after prior notification of Users

§9. Transactions with Entrepreneurs 

  1. This section of the Terms and Conditions and all provisions contained herein apply exclusively to Buyers and Users who are not consumers.

  2. An offer submitted by a Buyer who is not a consumer cannot be withdrawn.

  3. CardHorizon has the right to withdraw from a Sales Agreement concluded with a Buyer who is not a consumer within 14 (fourteen) calendar days from the date of its conclusion. Withdrawal from the Sales Agreement in such a case may occur without stating any reason and shall not give rise to any claims on the part of the Buyer who is not a consumer against CardHorizon.

  4. In the case of Buyers who are not consumers, CardHorizon has the right to limit available payment methods, including requiring full or partial prepayment, regardless of the payment method selected by the Buyer or the fact that the Sales Agreement has already been concluded.

  5. Upon handing the Goods over to the carrier, all benefits and burdens associated with the Goods and the risk of accidental loss or damage to the Goods transfer to the Buyer who is not a consumer. In such a case, CardHorizon shall not be liable for loss, shortage, or damage to the Goods occurring from the moment they are accepted for transport until delivery to the Buyer, nor for any transport delays.

  6. If the Goods are shipped to the Buyer via a carrier, the Buyer who is not a consumer must inspect the shipment at the time and in the manner customary for such shipments. If the Buyer discovers loss or damage to the Goods during transport, they must undertake all necessary actions to determine the carrier’s liability.

  7. Pursuant to Article 558 § 1 of the Polish Civil Code, CardHorizon’s warranty liability for defects of Goods towards a Buyer who is not a consumer is excluded.

  8. In the case of Users who are not consumers, CardHorizon may terminate the Electronic Service Agreement with immediate effect and without stating reasons by sending the User an appropriate statement.

  9. CardHorizon is liable toward a User or Buyer who is not a consumer only for typical damages foreseeable at the moment of contract conclusion and is not liable for lost profits.

  10. Any disputes arising between CardHorizon and a User or Buyer who is not a consumer shall be submitted to the court having jurisdiction over the registered office of CardHorizon.

  11. Subject to paragraph 12 below, a Buyer acquiring Goods in connection with their business or professional activity (a Buyer who is not a consumer) has the right to submit a complaint in accordance with applicable law, provided that warranty liability for physical defects of Goods is limited to the amount paid by the Buyer for the Goods in question.

  12. The provisions of these Terms and Conditions relating to consumers also apply to a natural person concluding a contract directly related to their business activity if the content of the contract indicates that it does not have a professional character for that person, in particular arising from the subject of the business activity disclosed in CEIDG (Central Register and Information on Economic Activity).

§10. Final Provisions 

  1. Agreements concluded via the Online Store are concluded in the Polish language. CardHorizon may provide translations of agreements into English; however, in the event of any discrepancies between the Polish and English versions, the Polish version shall prevail. The English version is for informational purposes only and is not legally binding. All legal matters shall be resolved exclusively based on the Polish version.

  2. Amendments to the Terms and Conditions:

    • CardHorizon reserves the right to amend the Terms and Conditions for important reasons, such as changes in applicable law, changes in payment or delivery methods, insofar as these changes affect the implementation of the provisions of the Terms and Conditions. Users will be informed of any amendments at least 14 days before they take effect. In the case of amendments significantly affecting User rights, CardHorizon reserves the right to additionally notify Users via e-mail.

    • For continuous agreements concluded under these Terms and Conditions (e.g., provision of the Electronic Service – Account), the amended Terms and Conditions shall be binding upon the User if the requirements of Articles 384 and 384[1] of the Polish Civil Code have been met—i.e., the User has been properly notified of the amendments and has not terminated the agreement within 14 calendar days of receiving the notice. If an amendment results in new fees or an increase in existing fees, the User who is a consumer has the right to withdraw from the agreement.

    • For agreements other than continuous agreements (e.g., Sales Agreements), amendments to the Terms and Conditions shall not affect acquired rights of Users/Buyers who are consumers before the date the amendments take effect. In particular, the amendments shall not affect Orders that have already been placed or submitted, nor Sales Agreements that have been concluded, are in progress, or have been performed.

  3. In matters not regulated by these Terms and Conditions, the applicable provisions of Polish law shall apply, in particular: the Polish Civil Code; the Act on Electronic Provision of Services of 18 July 2002; the Consumer Rights Act of 30 May 2014; and any other relevant universally binding legal provisions.
